Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Daisy CV (Pty) Ltd(“Daisy CV”, “DCV”, “we”, “us”, or “our”), a company registered in the Republic of South Africa, governing your access to and use of the Daisy CV recruitment platform, website, and related services (collectively, the “Platform”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
1. Definitions
In these Terms, unless the context indicates otherwise:
- “Candidate” means any individual who registers on the Platform to seek employment opportunities.
- “Employer” means any individual, company, or organisation that registers on the Platform to advertise vacancies or recruit Candidates.
- “Account” means a registered user account on the Platform.
- “Content” means all text, data, images, documents, CVs, job listings, and other materials uploaded to or generated on the Platform.
- “Services” means the recruitment, CV management, job matching, screening, and related services provided through the Platform.
- “Subscription” means a paid plan that grants access to premium features of the Platform.
- “POPIA” means the Protection of Personal Information Act, 2013 (Act 4 of 2013) of the Republic of South Africa.
- “Intellectual Property” means all patents, trademarks, service marks, trade names, domain names, copyrights, designs, trade secrets, know-how, and any other intellectual property rights.
2. Eligibility and Account Registration
2.1 Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under South African law to use the Platform.
2.2 Account Creation
To access certain features, you must create an Account by providing accurate, current, and complete information. You agree to update your information promptly if it changes.
2.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at [email protected] if you suspect any unauthorised access to or use of your Account.
2.4 One Account per User
Each individual or entity may maintain only one Account per role (Candidate or Employer). We reserve the right to suspend or terminate duplicate Accounts.
3. Platform Services
3.1 For Candidates
The Platform provides Candidates with the following Services:
- CV creation, management, and storage
- Job search and application tools
- AI-powered job matching and recommendations
- Skills assessments and profile optimisation
- Communication with Employers through the Platform’s messaging system
- Application tracking and status updates
- Self-service personal data export under POPIA
3.2 For Employers
The Platform provides Employers with the following Services:
- Job listing creation and management
- Access to the Candidate database (subject to Subscription level)
- AI-powered candidate screening and shortlisting
- Applicant tracking and pipeline management
- Interview scheduling and coordination
- Employment equity and B-BBEE reporting tools
- Communication with Candidates through the Platform’s messaging system
3.3 Service Availability
We will use commercially reasonable efforts to ensure the Platform is available 24/7, but we do not guarantee uninterrupted access. We may perform scheduled maintenance and will endeavour to provide reasonable notice of planned downtime.
4. Fees and Payment
4.1 Free and Paid Services
Certain features of the Platform are available free of charge. Premium features require a paid Subscription. Details of available plans and pricing are displayed on the Platform and are quoted in South African Rand (ZAR).
4.2 Payment Terms
All fees are payable in advance via the payment methods accepted on the Platform. Unless otherwise stated, fees are inclusive of Value-Added Tax (VAT) at the applicable rate.
4.3 Subscription Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your Subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period.
4.4 Refunds
Refunds are handled in accordance with the Consumer Protection Act, 2008 (Act 68 of 2008). If you believe you are entitled to a refund, please contact us at [email protected].
4.5 Price Changes
We reserve the right to change our pricing at any time. Existing Subscribers will be given at least 30 days’ notice of any price increase, which will take effect at the next renewal.
5. User Obligations and Conduct
5.1 General Obligations
You agree to:
- Use the Platform only for lawful purposes and in accordance with these Terms
- Provide accurate and truthful information in your Account and Content
- Comply with all applicable South African laws, including POPIA, the Employment Equity Act, and the Labour Relations Act
- Respect the rights and privacy of other Users
5.2 Prohibited Conduct
You must not:
- Post false, misleading, or fraudulent job listings or CV information
- Use the Platform to discriminate against any person on the basis of race, gender, sex, pregnancy, marital status, family responsibility, ethnic or social origin, colour, sexual orientation, age, disability, religion, HIV status, conscience, belief, political opinion, culture, language, birth, or nationality, in contravention of the Employment Equity Act
- Harvest, scrape, or collect personal information of other Users without their consent
- Distribute spam, unsolicited communications, or malware through the Platform
- Attempt to gain unauthorised access to other Accounts or Platform systems
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Use automated bots, scripts, or tools to access the Platform without our written permission
- Circumvent or manipulate the Platform’s security features or access controls
- Use the Platform for any purpose other than genuine recruitment activities
5.3 Employer-Specific Obligations
Employers additionally agree to:
- Ensure all job listings comply with the Employment Equity Act and are free from unfair discrimination
- Process Candidate personal information in accordance with POPIA and our Privacy Policy
- Not contact Candidates outside the Platform for recruitment purposes using information obtained solely through the Platform, unless the Candidate has given consent
- Provide accurate information about their company, the role, and remuneration
6. User Content
6.1 Ownership
You retain ownership of the Content you upload to the Platform. By uploading Content, you grant Daisy CV a non-exclusive, royalty-free, worldwide licence to use, store, display, and process your Content solely for the purpose of providing and improving the Services.
6.2 Content Standards
All Content must be accurate, lawful, and not infringe on the rights of any third party. We reserve the right to remove Content that violates these Terms or applicable law, without prior notice.
6.3 CV and Profile Information
Candidates acknowledge that their CV and profile information may be visible to Employers using the Platform, subject to the Candidate’s privacy settings. Candidates can control the visibility of their profile at any time through their Account settings.
7. Intellectual Property
7.1 Platform IP
The Platform, including its design, software, algorithms, logos, trademarks, text, graphics, and other materials (excluding User Content), is the property of Daisy CV or its licensors and is protected by South African and international Intellectual Property laws.
7.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purposes, subject to these Terms. This licence does not include the right to:
- Modify or create derivative works based on the Platform
- Use the Platform’s Intellectual Property for commercial purposes outside the Services
- Sub-licence, sell, or transfer your access to the Platform
7.3 Feedback
If you provide suggestions, ideas, or feedback about the Platform (“Feedback”), you grant us a perpetual, irrevocable, royalty-free licence to use such Feedback for any purpose without compensation to you.
8. AI and Automated Decision-Making
The Platform uses artificial intelligence and automated tools for candidate screening, job matching, and CV parsing. You acknowledge the following:
- AI-generated recommendations and scores are advisory and do not constitute final employment decisions
- Employers remain solely responsible for all hiring decisions
- Candidates have the right to request human review of any automated decision that significantly affects them, as provided under POPIA Section 71
- We regularly audit our AI systems for bias and fairness in accordance with South African employment equity requirements
9. Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal information in compliance with POPIA and, where applicable, the EU General Data Protection Regulation (GDPR).
By using the Platform, you consent to the collection and processing of your personal information as described in our Privacy Policy. For information about cookies, please refer to our Cookie Policy.
10. Limitation of Liability
10.1 No Employment Guarantee
Daisy CV is a recruitment platform and does not guarantee employment for Candidates or successful recruitment for Employers. We act as an intermediary and are not a party to any employment contract between Users.
10.2 Limitation
To the maximum extent permitted by South African law, including the Consumer Protection Act:
- Daisy CV shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform
- Our total aggregate liability for any claim arising from these Terms or your use of the Platform shall not exceed the greater of (a) the fees paid by you to Daisy CV in the 12 months preceding the claim, or (b) R5 000
- We are not liable for the accuracy, legality, or quality of any Content posted by Users, including job listings and CV information
10.3 Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, government actions, pandemics, or labour disputes.
11. Indemnification
You agree to indemnify, defend, and hold harmless Daisy CV, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
- Your breach of these Terms
- Your violation of any applicable law or regulation
- Your Content or your use of the Platform
- Any dispute between you and another User
- Any third-party claim arising from your use of the Platform
12. Termination
12.1 Termination by You
You may close your Account at any time by contacting us at [email protected] or through your Account settings. Upon closure, your access to paid features will cease at the end of the current billing period.
12.2 Termination by Us
We may suspend or terminate your Account immediately and without notice if:
- You breach any material provision of these Terms
- We are required to do so by law or a court order
- Your conduct may expose Daisy CV or other Users to legal liability or harm
- Your Account has been inactive for more than 24 consecutive months
12.3 Effect of Termination
Upon termination:
- Your right to access and use the Platform ceases immediately
- We may retain your personal information in accordance with our Privacy Policy and POPIA retention requirements
- Provisions that by their nature should survive termination (including Sections 6, 7, 10, 11, and 13) shall continue in full force
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict-of-law principles.
13.2 Dispute Resolution
In the event of any dispute arising from these Terms or your use of the Platform, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may refer the matter to mediation administered by the Arbitration Foundation of Southern Africa (AFSA). If mediation is unsuccessful, the dispute shall be finally resolved by arbitration under the AFSA Rules.
13.3 Jurisdiction
Notwithstanding Section 13.2, either party may approach the High Court of South Africa (Gauteng Division, Johannesburg) for urgent interim relief.
14. General Provisions
14.1 Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Daisy CV regarding your use of the Platform and supersede all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Daisy CV.
14.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
14.5 Notices
Notices to you will be sent to the email address associated with your Account. Notices to Daisy CV should be sent to [email protected] or by post to our registered address.
14.6 Electronic Communications
In accordance with the Electronic Communications and Transactions Act, 2002 (Act 25 of 2002), you consent to receiving communications from us electronically. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
14.7 Amendments
We reserve the right to amend these Terms at any time. Material changes will be communicated to you via email or a prominent notice on the Platform at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the amended Terms.
